Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Niche Teacher website (nicheteacher.com) and all tools, features, and content available through it (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who May Use the Service

Niche Teacher is designed for K-12 teachers, instructional coaches, curriculum developers, and other school staff who are 18 years of age or older. The Service is not intended for use by students — it is a professional planning tool used by educators, not a student-facing application. We do not market to or knowingly collect information from students of any age, including students under 13 as defined by the Children's Online Privacy Protection Act (COPPA). If you are under 18, you may only use the Service under the supervision of a parent, guardian, or educator who agrees to these Terms on your behalf.

By using the Service, you represent that (a) you are at least 18 years old or are using the Service under adult supervision as described above, (b) you have the authority to enter into these Terms, and (c) your use of the Service will comply with all applicable laws and regulations.

2. The Free Tier

The free tier of Niche Teacher allows up to 3 generations per day without creating an account. The free-tier limit is enforced using browser local storage. You agree not to circumvent, manipulate, or artificially reset the generation counter through technical means. Doing so may result in termination of your access.

3. AI-Generated Content — Important Disclaimer

The Service uses artificial intelligence (OpenAI's GPT-4o model) to generate lesson plans, rubrics, worksheets, and related educational materials. All AI-generated content is provided for informational and instructional-planning purposes only. You acknowledge and agree that:

• AI-generated content may contain inaccuracies, errors, or omissions.
• Generated lesson plans, rubrics, and worksheets are starting points and should be reviewed, edited, and validated by a qualified educator before use with students.
• Niche Teacher does not guarantee that generated content complies with any specific state standard, school policy, IEP requirement, 504 plan, or legal mandate.
• You are solely responsible for the suitability of any generated content for your students, classroom, school, or district.
• Content that references educational standards (Common Core, NGSS, TEKS, etc.) is generated by AI and has not been reviewed or endorsed by the organizations that publish those standards.

IEP and special education modifications: Any IEP or differentiation suggestions generated by this Service are general instructional strategies only. They are not individualized education program documentation, do not constitute legal advice, and do not satisfy any obligation under the Individuals with Disabilities Education Act (IDEA) or Section 504 of the Rehabilitation Act. All IEP and 504 decisions must be made by the student's IEP or 504 team.

4. Acceptable Use

You agree not to use the Service to:

• Generate content that is harmful, abusive, discriminatory, or harassing toward any person or group
• Generate, distribute, or use content that violates any applicable law or regulation
• Enter personally identifiable information about students, including student names, student IDs, Social Security numbers, addresses, or other information protected by FERPA or COPPA
• Scrape, crawl, or systematically extract content from the Service using automated tools
• Reverse engineer, decompile, or attempt to extract the source code or underlying models of the Service
• Resell, sublicense, or commercially redistribute generated content without attribution or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Use the Service in any way that could damage, disable, overburden, or impair it

5. Intellectual Property

Your content

You retain ownership of the input you provide to generate documents (e.g., subject, topic, grade level). You also own the generated output you create using those inputs, subject to any applicable terms of the underlying AI provider (OpenAI). You are responsible for ensuring your use of generated content complies with your school or district's policies.

Our content

The Niche Teacher name, logo, website design, blog articles, and all other original content and software on the Site are owned by or licensed to Niche Teacher and are protected by intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from our proprietary content without written permission.

Third-party standards references

References to educational standards (e.g., Common Core State Standards, NGSS, TEKS) are used for informational purposes. Those standards are the property of their respective owners and their inclusion does not imply endorsement by or affiliation with those organizations.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY GENERATED CONTENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NICHE TEACHER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR ANY GENERATED CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED $100 USD.

9. Indemnification

You agree to indemnify and hold harmless Niche Teacher and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Changes to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We may update these Terms from time to time. When we do, we will update the effective date above. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

11. Termination

We may restrict or terminate your access to the Service at any time, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our discretion.

12. Affiliate Links and Sponsored Content

Some pages on Niche Teacher, including blog posts and resource pages, may contain affiliate links to third-party products or services (such as Teachers Pay Teachers). If you click an affiliate link and make a purchase, we may earn a small commission from the third party at no additional cost to you. Our full affiliate disclosure is available at nicheteacher.com/disclosure.

The presence of an affiliate link does not constitute an endorsement of any specific product, service, or vendor. We only link to products and services we believe are genuinely useful to K-12 educators. Affiliate relationships do not influence the output of our lesson plan, rubric, or worksheet generators.

13. Governing Law and Disputes

These Terms are governed by the laws of the United States and the state in which Niche Teacher is incorporated, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction. Nothing in this section limits your rights as a consumer under applicable law.
